Erin Andrews Wants Hotel to Pay Full $55M Award

Attorneys for Erin Andrews say a Nashville hotel owner and its operator should pay the total $55 million a jury awarded the television broadcaster earlier this month.

According to The Tennessean, The attorneys say the companies should not split the payment with Andrews' stalker, Michael David Barrett. That probably would increase the amount of money Andrews is actually able to get.

A Nashville jury on March 7 awarded Andrews $55 million after a nine-day trial. In 2008, Barrett altered a door peephole and secretly recorded a video of her naked inside her hotel room at Nashville Marriott at Vanderbilt University and later posted the video online. Andrews worked for ESPN at the time. She now works for Fox Sports and co-hosts ABC's "Dancing with the Stars."

The jury found that West End Hotel Partners, the hotel owner, and Windsor Capital Group, the management company, were at fault for allowing Barrett to book the room next to Andrews.

Jurors said Barrett was 51 percent responsible, and the hotel owner and operator 49 percent responsible for the harm Andrews suffered. That split meant Andrews was unlikely to get the full $55 million award because Barrett probably is unable to pay his share.

The filing cites a complex legal issue involving joint and several liability. It argues that because the jury found the hotel companies at least partially responsible, that means the jury also found that the hotel companies should have foreseen Barrett's actions.
