Radio groups are backing iBiquity Digital’s legal action and asking the judge in an HD Radio patent infringement lawsuit to dismiss the case, according to RadioWorld.
The 14 radio groups sued by Wyncomm/Delaware Radio Technologies last year for using HD Radio technology deny the three patents in contention were “duly and legally issued” by the U.S Patent & Trademark Office between 1995 and 1997. Wyncomm/DRT has alleged it owns three telephony-based patents related to HD Radio technology.
Beasley Broadcast Group, CBS Radio, Clear Channel parent CC Media Holdings, Cox Media Group, Cumulus Media, Entercom, Entravision, Greater Media, Hubbard Radio, Radio Disney, Radio One, Saga, Townsquare Media and Univision tell U.S. District Court Judge Gregory Sleet that the plaintiffs, Wyncomm/DRT, are not entitled to relief because they “do not practice the purported inventions” of the three patents, so they couldn’t have suffered “any irreparable harm from any alleged injury.”
Finally, they tell the judge the three patents “are unenforceable due to patent expiration and/or prior licenses.”
