The Guess Who Settles Legal Battle Over Group's Name

A legal dispute over a popular rock band’s name usage has been resolved after months of negotiations between former bandmates.

Randy Bachman and Burton Cummings, co-founders of the Guess Who, filed a lawsuit against former bandmates Garry Peterson and Jim Kale over false advertisement back in October of 2023. The lawsuit claimed Peterson and Kale led fans to believe Bachman and Cummings, who had left the group years ago, were still part of their band that was recording and touring under the Guess Who name even though they were not.

Bachman, 80, and Cummings, 76, told Rolling Stone that shared trademarks have been worked out with the former bandmates although details of the settlement have not been announced.

“We are pleased to have reached a resolution that honors our shared history and allows us to move forward with a new sense of purpose and camaraderie,” Bachman told Rolling Stone.

The ‘60s and ‘70s Canadian rock staple, originally named Chad Allan and the Reflections, was formed in Winnipeg by Bachman, Kale, Peterson, Bob Ashley and Chad Allan. The name change came in 1965.

Cummings and Bachman said it was an arduous process, but they are relieved they resolved the situation.

“It was painful, but we’d have done it indefinitely just to stop that fake band from taking over our history,” Cummings told Rolling Stone. “They took over streaming sites; they were using old photos of me and Randy. It gets me going thinking about it, but that’s over. It’s a painful success. It cost a lot of money with lawyers and I gave up a lot of publishing money, but we finally won this terrible battle.”

The Guess Who is famous for hits like “No Sugar Tonight (New Mother Nature),” “American Woman,” “These Eyes” and more.

Activists Interrupt CNN’s Dana Bash Book Event

A pair of pro-Palestinian, anti-Israel protesters interrupted a book event featuring CNN’s Dana Bash at the Politics and Prose bookstore in Washington D.C. on Thursday evening, making a number of bizarre claims as they attempted to confront the cable news anchor.

TheWrap reports the second speaker alleged with no evidence that Bash reported on Israeli hostages in order to receive “millions from Zionists” and the pro-Israel American Israel Public Affairs Committee lobbying organization, better known as AIPAC.

Video of the protesters yelling at Bash was shared on social media, taking place at the event meant to promote her new American history book as she was joined in conversation by journalist Kara Swisher.

The edited footage begins with a young woman wearing a surgical mask standing up and shouting at Bash, beginning, “After World War II, every single journalist that was complicit in their war crimes was charged.”

Report: Harris Campaign Got Debate 'Assurances' From ABC News

Vice President Kamala Harris agreed to the final rules for the ABC News debate against former President Trump, allegedly following a few "assurances" from the network.

On Wednesday, ABC News released the official rules for Tuesday's debate between Harris and Trump, including the hotly contested rule that microphones be muted while a candidate is speaking.

The Harris campaign repeatedly pushed back on this rule, attempting to goad Trump into backing out of the original agreement to mute mics, even refusing to sign off on the rules last week in an attempt to renegotiate.

CNN reported Wednesday that Harris accepted the rules after receiving separate "assurances" that mics could be turned on during the debate and the moderators would explain unheard exchanges.

"ABC News has offered assurances to the Harris campaign that if there is significant cross talk between Harris and Trump, the network may choose to turn on the mics so that the public can understand what is happening, the moderator would discourage either candidate from interrupting constantly and the moderator would also work to explain to viewers what is being said, according to the source familiar," CNN reported.

The source allegedly added that pool reporters will also be in the room to report on what could be heard while mics are muted to TV audiences.

An ABC spokesperson told Fox News Digital, "Beyond the debate rules published today, which were mutually agreed upon by two campaigns on May 15, we have made no other agreements. We look forward to moderating the presidential debate next Tuesday."

Fox News Trump PA Town Hall Was Lovefest

For former President Donald J. Trump, Wednesday’s town hall in Harrisburg was more like batting practice.

PennLKive.com reports Fox News broadcaster Sean Hannity - with help from pre-selected audience members - teed up all of Trump’s favorite whipping boys from Democrats to undocumented immigrants to the “fake news media,” and then sat back as the former president tried to smash them out of the park.

Little news was made, though Trump, in response to an audience question, did provide some interesting insight into how his hoped-for second term would be different from the first: He now has, Trump said, a better idea of who he wants to work for him in the White House and federal agencies.

In the first term from January 2017 through January 2021, Trump said, he was saddled with staffers ad appointees who “in some cases were not what I really wanted, because I didn’t really know Washington.”

That’s different now, the former president said.

“A big key to running it is to get the right people. You get the right persons and the right group of people at the heads of these massive agencies, and you’re going to have tremendous success... and I know ‘em all now.”

To some degree, the event was a little like debate prep for Trump, who is scheduled to share the stage with Vice President and Democratic presidential nominee Kamala Harris next Tuesday on the ABC broadcast network.

Hannity is known as one of Trump’s most-favored broadcasters. The former president frequently turns up on Hannity’s show for studio interviews or more impromptu call-ins, and this is the third “town hall-style” setting that the two have shared since last summer.

Trump noted the difference in the setting at several points when Hannity brought up the upcoming debate, contending that as he sees it ABC is the “most unfair” of the news media outlets.

Cord Cutting Wipes Out 1.6M Subscribers During 1H 2024

Second quarter pay TV cord-cutting resulted in a 1.6 million subscriber decline -- bringing the first six months of 2024 to a “mind-boggling” 4.08 million, according to Mediapost citing MoffettNathanson Research estimates.

Each of the first and second quarters registered a 6.9% decline  versus the same periods the year before. In 2023, the first two quarters had 6.8% drops, where there was also a collective 4.07 million decline.

Total U.S. linear pay TV subscribers now stand at 68.8 million.

Taking out newer virtual pay TV services (YouTube TV, Hulu+Live TV, for example) the traditional pay TV systems (cable, satellite, telco) posted worse declines -- 12.6% in the second quarter and 12.3% in the first quarter. That total now stands at 49.8 million subscribers.

Virtual pay TV platforms posted a collective second quarter 49,000 gain -- a 12.4% rise versus the same period a year ago, now totaling 19 million. YouTube TV gained 50,000; Sling TV, 78,000; and DirecTV Now, 82,000. Posting losses: Hulu+Live TV, 100,000; and Fubo TV, down 21,000.

YouTube TV continues to be the leader among virtual pay TV, now at 8 million subscribers.

MoffettNathanson Research says converting those traditional pay TV subscribers -- who have abandoned services (cord-cutters) -- into virtual pay TV services -- continues at a modest pace in the period, a 29% conversion 12-month trailing rate.

The trailing 12-month rate of securing traditional pay TV subscribers has remained in the 25% to 30% range since the first quarter of 2020.

Lower subscriber numbers also mean declining overall affiliate fees for major TV network groups. Collectively, the top six TV network groups had affilate revenues sinking 6.3% in the second quarter to $8.5 billion.

U-S: Russia Funded Media Paid Right-Wing Influencers Millions

Two Russian nationals working for a news network controlled by Vladimir Putin's government funneled millions of dollars to an American media company that paid right-wing influencers for videos pushing narratives favorable to the Kremlin, U.S. prosecutors alleged on Wednesday.

CBS News reports an indictment unsealed in the Southern District of New York charged Kostiantyn Kalashnikov and Elena Afanasyeva, both based in Moscow, with conspiracy to launder money and conspiracy to violate the Foreign Agents Registration Act. The indictment came as the Justice Department unveiled sprawling allegations accusing the Russian government of meddling in the 2024 U.S. elections.

The two defendants worked for RT, a media outlet formerly known as Russia Today that is funded and controlled by the Russian government, the indictment said.

Federal prosecutors said RT oversaw a series of "covert projects" that included funneling $10 million through a series of shell entities to a Tennessee-based company launched in 2023 that publishes videos on TikTok, Instagram, YouTube and X, formerly known as Twitter.

Though the company is not named in the indictment, prosecutors said that it describes itself as a "network of heterodox commentators that focus on Western political and cultural issues" and features six commentators as its "talent." Tenet Media describes itself using the same phrase on its website, and other details in the indictment align with the firm. Its website lists six right-wing personalities, including Dave Rubin, who has more than 2.4 million YouTube subscribers; Tim Pool, a podcast host with more than 1.3 million YouTube followers; and Benny Johnson, whose YouTube channel has nearly 2.4 million subscribers.

In response to the indictment of the two Russians, Pool wrote on social media, "Should these allegations prove true, I as well as the other personalities and commentators were deceived and are victims. I cannot speak for anyone else at the company as to what they do or to what they are instructed." He said his podcast was licensed by Tenet Media and existed before the license agreement. Pool also said he had full editorial control of the show and its contents, which he said are "often apolitical."

Radio History: Sep 5

➦In 1910...Kenneth Howard Delmar born in Boston (Died at age 73 - July 14, 1984, Stamford, Connecticut). He was an actor active in radio, films, and animation. An announcer on the pioneering radio news series The March of Time, he became a national radio sensation in 1945 as Senator Beauregard Claghorn on the running "Allen's Alley" sketch on The Fred Allen Show.

Kenny Delmar
The character Delmar created was a primary inspiration for the Warner Bros. cartoon character Foghorn Leghorn.

By the late 1930s, Delmar was an announcer on such major radio series as The March of Time and Your Hit Parade. He played multiple roles in The Mercury Theatre on the Air's October 1938 radio drama The War of the Worlds.

Delmar is notable for creating the character Senator Beauregard Claghorn on Fred Allen's radio program Allen's Alley, which he did while also serving as the show's regular announcer. Senator Claghorn made his radio debut October 7, 1945, and six months later was called "unquestionably the most quoted man in the nation" by Life magazine. The role inspired the Warner Bros. animated character Foghorn Leghorn, first seen in the Oscar-nominated cartoon Walky Talky Hawky (1946).

"During the late 1940s, Mr. Delmar captivated 20 million radio listeners every Sunday night with his burlesque of a bombastic, super-chauvinistic legislator who drank only from Dixie cups and refused to drive through the Lincoln Tunnel," wrote The New York Times. "His stock expression, 'That's a joke, son,' was for many years one of the nation's pet phrases, mimicked by children and businessmen alike.

Delmar was also announcer and voice performer on The Alan Young Show in 1944. In 1953 he returned to radio replacing Hans Conried's character on My Friend Irma, as the Professor's cousin, Maestro Wanderkin and as Conried's Schultz on Life with Luigi.

➦In 1938…'Life Can Be Beautiful' began airing.  It was a daytime drama broadcast on NBC and CBS during its 16-year run. The program was billed as "an inspiring message of faith drawn from life" and remained one of the leading soap operas through the 1940s. Sponsored by Procter & Gamble and Spic and Span, it premiered September 5, 1938 on NBC and moved two months later to CBS, where it was heard from November 7, 1938 to June 21, 1946. Concurrently, it was also airing on NBC from 1939 to 1941. The final run was on NBC from 1946 to 1954.

➦In 1957...WPOW 1330 AM became one of the first NYC stations to air Rock & Roll regularly. Today the station airs a Spanish Christian music and teaching format and is owned by Radio Vision Cristiana Management.

➦In 1966...The Monkees released their first single--"Last Train to Clarksville".

➦In 1987...“American Bandstand,” hosted by Dick Clark on ABC, was cancelled after 30 years on network television, largely due to MTV's influence. The show limped along on the USA cable channel and in syndication for another three years, with a different host.

➦In 1989...Mike and the Mad Dog debuted on Emmis' WFAN 660 AM in NYC. The station was looking for hosts to replace Pete Franklin during PM drive time and program director  Mark Mason, floated the idea of teaming Mike Francesa with Chris Russo. At first, the station management thought the idea was crazy because they were no-names at that time.  However, because of Francesa and Russo's popularity on the weekends and on Imus in the Morning individually, the station management decided to pair the two together.

The show aired WFAN from September 1989 to August 2008 and featured Francesa and Russo talking about sports and taking phone calls from listeners. From 2002 the show was simulcast on television on the YES Network. On the radio, the show was simulcast beginning 2007 on WQYK in Tampa, Florida and from 2004 until 2007 on WROW in Albany, New York.

➦In 2002...John Daly "Jackie" Kelk died at age 79 from a lung infection (Born - August 6, 1923). He was a stage, radio, film, and television actor and stand-up comedian. Kelk was best known for portraying the role of Homer Brown on the radio series The Aldrich Family and as the original voice of Jimmy Olsen on The Adventures of Superman.

➦In 2012...Joe South, singer, songwriter and guitarist who did "Games People Play" and "Walk a Mile in My Shoes", died of heart failure in Buford, Georgia at age 72.  South also wrote songs for Elivs Presley, Deep Purple, the Osmonds, Gene Vincent, Lynn Anderson ("Rose Garden") and Billy Joe Royal and worked with Aretha Franklin, Bob Dylan, Tommy Roe and others.
