9/21 WAKE-UP CALL: Interest Rates Remain At 22-Year High

The Fed voted to hold interest rates at a 22-year high but signaled it could raise them once more this year to combat inflation. This is the second pause in 2023 after central bankers also kept rates steady in June. In July, the Fed increased its benchmark federal-funds rate to a range between 5.25% and 5.5%. It began lifting rates from near zero in March 2022. Because it can take a year or longer for rate increases to slow economic activity, Fed Chair Jerome Powell has said gradual hikes would give officials more time to assess the impact. They meet again on Oct. 31-Nov. 1 and in December.

➤U-S COMPANIES GETTING NEW CARBON-DISCLOSURE RULES: Carbon-disclosure rules for U.S. companies are coming sooner than expected. California and the EU are poised to approve regulations requiring companies that do business within their borders to release information about their greenhouse-gas emissions, including from their suppliers and customers. Those are stricter directives than rules that the SEC has proposed. The size of the California and EU economies—the world’s sixth and third largest, respectively, if they were countries—means few large companies can duck their rules. Businesses and Republicans have fought the SEC’s efforts to make one of the biggest changes in corporate disclosures in decades.

➤WRITER'S STRIKE COULD END TODAY: Writers and producers are near an agreement to end the Writers Guild of America strike after meeting face to face on Wednesday, people close to the negotiations told CNBC. The two sides met and hope to finalize a deal Thursday, the sources said. While optimistic, the people noted, however, that if a deal is not reached the strike could last through the end of the year. On Wednesday evening, the WGA and the Alliance of Motion Picture and Television Producers released a joint statement that the two groups met for bargaining and would meet again on Thursday.

➤UNMANNED JET TRAVELED SOME 60-MILES:  The F-35 Lightning II stealth fighter jet that went missing in South Carolina flew without its pilot for about 60 miles before crashing into a wooded area. The debris from the jet was found Monday after the pilot ejected and parachuted to safety into a residential backyard on Sunday. But many questions remain amid an ongoing investigation into the incident. The U.S. Marine Corps hasn't yet released much information about how the "most expensive" aircraft went missing and crashed. "How in the hell do you lose an F-35?" Rep. Nancy Mace, R-S.C., wrote on X, formerly Twitter. "How is there not a tracking device and we’re asking the public to what, find a jet and turn it in?"

➤TEXAS GOVERNOR BLASTS BIDEN:
Greg Abbott has deployed the National Guard to re-install razor wire to deter migrants - as one mayor declared an emergency amid an influx of 14,000 people. The Texas Governor launched a blistering attack on Joe Biden on Wednesday, slamming him for 'cutting the wire' and assuring Texans he was having it repaired. He shared footage of members of the Texas National Guard unravelling the new barrier before putting it up along the besieged banks of the Rio Grande. It comes as Eagle Pass is overwhelmed by migrants flooding the border, with 4,000 crossing on Wednesday, 14,000 since last week and 270,000 this year. Mayor Rolando Salinas declared a state of emergency after thousands overran Mission Border Hope, the only migrant shelter in the city. Despite the desperation, Biden on Wednesday granted temporary work permits to 472,000 Venezuelans who arrived in the country between January 1 and July 31.

CPB Invests $2.25 Million in State Government Coverage

The Corporation for Public Broadcasting (CPB) is investing $2.25 million to increase and strengthen state government coverage provided by public media station newsrooms. The grants were announced today at the Public Media Content Conference in Philadelphia.

Amid an industry drop in the overall number of full-time statehouse reporters across the country, CPB funds will support seven stations as they add statehouse reporting capacity. The coverage must be shared with public media stations across the state, as well as other media organizations. CPB funds will also support NPR’s ability to provide editorial and training support for station-based reporters covering state government.

“The American people look to public media to provide high quality journalism in the form of factual, trusted news and information,” said Patricia Harrison, CPB President and CEO. “A strong civil society and democracy requires its citizens be informed with the facts. This is especially important when it comes to state government reporting. Unfortunately, today there are far fewer full-time journalists covering our nation’s statehouses than just a decade ago. These CPB grants will address an urgent need as we increase the number of journalists at public media stations reporting statehouse news and policy decisions. Their coverage will be made available to all citizens in those seven states.”

RIFs Hit Sony Group Podcasts

Sony Group laid off staff in its podcast business and canceled a program it produced featuring model and author Emily Ratajkowski, according to Bloomberg citing people with knowledge of the decision.

High Low with EmRata premiered last year and consisted of three episodes released weekly. The program attracted a large segment of listeners internationally, but struggled to sell advertising because brands primarily wanted to reach US consumers, said the people, who asked to not be identified because the decision hasn’t been made publicly.

Ratajkowski will seek a new home for her show, one of the people said. Sony declined to comment about the program.

Radio History: September 21

➦In 1943...WNYC-FM call letters debut.

WNYC began regularly scheduled broadcasts on the FM band on March 13, 1943 at 43.9 megacycles. Known originally as W39NY, the FM outlet adopted its present WNYC-FM call letters and its present frequency of 93.9 MHz within a few years.

➦In 1948..."Life With Luigi" debuted on the CBS Radio Network. It continued to March 3, 1953.

➦In 1965..KYW 1060 AM in Philadelphia flipped to an all-news format.

KYW began in 1921 in Chicago, Illinois. It was jointly owned by Westinghouse Electric Corporation and Commonwealth Edison. Westinghouse later bought out ComEd's share and became sole owner of the station.

In 1927, Westinghouse aligned its four radio stations (KYW, KDKA in Pittsburgh, WBZ in Boston and WBZA in Springfield, Massachusetts) with the NBC Blue Network, which originated from former sister station WJZ (the present-day WABC) in New York City. Westinghouse had been a founding partner of the Radio Corporation of America (RCA), NBC's original parent company.

On September 21, 1965, shortly after Westinghouse regained control of 1060 AM, the newly rechristened KYW once again dropped its NBC radio affiliation and was converted into one of the first all-news stations in the country.  Newsman Steve Porter read the first newscast. It had been edited by Fred B. Walters, the former Harrisburg bureau chief and eventual Executive Editor.

Five months earlier Westinghouse Broadcasting converted 1010WINS, KYW's New York sister station since 1962, from a Top-40 format to all-news.  A similar move was made three years later at another Westinghouse-owned station, KFWB in Los Angeles.  KYW has been one of the highest-rated radio stations in the country since that point and has been the market leader in Philadelphia for much of that time. The Westinghouse all-news trio, meanwhile, revolutionized and defined the all-news format. KYW's early format elements were shared with WINS, such as the distinctive teletype sound effect playing in the background, and the slogans "All News, All the Time", "The Newswatch Never Stops", "Listen 2, 3, 4 Times a Day" and "You Give Us 22 Minutes, We'll Give You the World".

KYW's present format runs on a 30-minute cycle. Regular segments include contains traffic and mass transit reports from Metro Traffic every ten minutes on the "twos" (six times an hour), sports updates every quarter-hour (twice an hour, at :15 and :45), weather reports as much as six times an hour (four regularly scheduled reports at :07, :14, :37 and :44 past every hour with breaking weather news plus special forecasts for the New Jersey Shore and the Poconos), and business news from Bloomberg twice an hour (at :25 and :55). When breaking news warrants, KYW will break format to provide continuous coverage of any event.

TV Ratings: CNN Tanks In Key Demo

Ratings-challenged CNN hit rock bottom in a key viewership demographic last weekend — another sign of the difficulties facing incoming boss Mark Thompson.

The NY Post reports the cable news network logged its worst weekend ratings on record in the all important 25- to 54-year-old demo, according to the latest Nielsen data released Tuesday.

CNN — which launched in 1980 and bills itself as “the most trusted name in news” — totaled just 55,000 viewers for its weekend slate of shows that include Sunday political programs “State of the Union with Jake Tapper and Dana Bash,” and “Fareed Zakaria GPS.”

The network’s Sunday primetime lineup, which featured “The Whole Story with Anderson Cooper” and “Stanley Tucci: Searching for Italy,” drew 43,000 in the demo.

The ratings are the network’s worst since 1991 — the earliest TV data is readily available. Data prior to 1991 is largely not digitized.

CNN’s overall viewership wasn’t much better.

The network logged 345,000 total viewers, trailing Fox News’ 683,000 and MSNBC’s 424,000. Fox won the battle in the key demo as well, drawing 75,000 viewers to top MSNBC’s 47,000, which finished behind CNN.

“CNN is a ratings embarrassment,” an industry insider said. “At least with Thompson they will have a direction.”

CNN Bets On New CEO Mark Thompson To Focus

When former CNN Chief Executive Officer Chris Licht started running the news organization last year, he was given a mission by his boss, Warner Bros. Discovery

CEO David Zaslav: change the network’s programming and tone to emphasize news rather than “advocacy” journalism.

With Licht now fired, CNN’s incoming CEO, Mark Thompson, has a new mission: everything else, according to CNBC.com.

Mark Thompson
Thompson, who starts at CNN on Oct. 9, has had preliminary discussions with Zaslav and other members of CNN’s leadership about strategic ideas and priorities, according to people familiar with the matter, who declined to speak on the record because the discussions were private. He has made no decisions about CNN’s operations and won’t until he has had a chance to meet with staffers and learn the business, said the people.

Still, some areas of emphasis are clear. Thompson will focus on building digital subscription businesses around CNN.com and creating programming for a younger audience on CNN Max, the network’s live news service on Warner Bros. Discovery’s “Max” streaming service, said two of the people.

Much of Licht’s short reign, which lasted a little over a year, centered around depoliticizing CNN. Zaslav and Licht agreed that CNN had gotten a reputation as left-leaning, and tried to refocus the network as a down-the-middle outlet that could appeal to both Democrats and Republicans. Licht and CNN’s leadership since his firing — a four-person team of Amy Entelis, Virginia Moseley, Eric Sherling and David Leavy — overhauled CNN’s linear shows, including debuting a new morning show and a revamped prime-time lineup.

Licht struggled to win over CNN employees by purposely taking a hands-off approach to differentiate his style from former CNN chief Jeff Zucker, who resigned in February 2022 after failing to disclose a consensual relationship with a coworker. Zaslav felt Licht moved too slowly to make decisions and didn’t appropriately relate to CNN’s talent, according to people familiar with the matter. Licht believed he couldn’t be his authentic self given Zaslav’s mandate to be a no-nonsense leader who had to reform CNN’s image and cut costs, the people said. Licht had to lay off hundreds of employees as part of a broader Warner Bros. Discovery head count reduction.

Philly Radio: Beasley Sues Anthony Gargano For Breach of Contract

Beasley Media Group filed a lawsuit against Anthony Gargano of WPEN 97.5 The Fanatic on Monday, claiming the radio station's midday host violated a non-compete term in his employment contract by accepting a position at the AllCity digital sports network. The complaint, filed in U.S. District Court in Philadelphia, also names Denver-based AllCity Network as a defendant for allegedly poaching The Fanatic's employees.

The Philly Business Journal reports, Beasley filed the lawsuit to make sure Gargano complies with the terms of his employment agreement, which restricts him from “performing certain competitive acts within the Philadelphia market during his employment and for six months thereafter.” The company said his contract expires Oct. 7, 2024.

Beasley also said the lawsuit is designed to “prevent All City from running roughshod over Beasley’s Agreement with Gargano, a strategy that All City and Gargano have apparently hatched in order to steal Beasley’s investments for their own new venture in Philadelphia.”

The lawsuit accuses Gargano of breach of contract and breach of duty of loyalty. AllCity is accused of tortious interference with contract. The lawsuit seeks to enforce the terms of Gargano’s contract, which would prevent him from working for AllCity until six months after his deal with Beasley expires. The suit also seeks financial damages.

Gargano has worked at The Fanatic since moving over in 2015 from rival SportsRadio 94 WIP-FM, first as the sports talk station's morning drive host and then in his current midday host role. With Mike Missanelli's departure last year, Gargano is perhaps The Fanatic's highest profile on-air talent who has deep connections with sponsors.

In its complaint, Beasley said under his employment contract and the common law duty of loyalty, Gargano is prohibited from providing services to a competing business while he is employed by Beasley. Despite this, the lawsuit claims Gargano notified Beasley on Sept. 11 that while he intends to continue his role at The Fanatic, he had accepted employment at AllCity, where he will perform on podcasts, write articles for its website and create other content that Beasley believes will compete directly with The Fanatic.

In an interview Tuesday, AllCity co-founder and CEO Brandon Spano called the lawsuit “disappointing.” He said AllCity wanted to collaborate with Beasley, with the idea being that Gargano could work for both outlets. He said he believes The Fanatic is a completely different medium than AllCity and reaches a different audience.

Beasley said in its lawsuit that the company did not learn of AllCity’s offers to its employees until August. Gargano approached station manager Chuck Damico and asked if he could continue his Fanatic show while also working for AllCity, according to the complaint. He also suggested The Fanatic and AllCity partner and Beasley run the station’s shows on AllCity’s platform. Beasley said it declined Gargano’s request.

9/20 WAKE-UP CALL: Hunter Expected To Plead 'Not Guilty'

Hunter Biden plans to plead not guilty to federal gun charges and is asking his initial court appearance be held by video conference so that he won't have to travel to Wilmington, Delaware, a request that the government opposed. U.S. Magistrate Judge Christopher Burke asked both sides to file written arguments about a video hearing. The government is scheduled to respond Wednesday. The initial hearing hasn't been scheduled yet. Congressional Republicans have attacked the charges against Biden and the handling of his investigation as a "sweetheart deal" because his father is President Joe Biden. Being treated differently from typical defendants for a court appearance could also raise complaints of favoritism by David Weiss, the U.S. attorney in Delaware who was appointed special counsel.

➤U-N URGED TO CONFRONT AGGRESSION: President Biden and Ukrainian President Volodymyr Zelensky called on their counterparts to defend the idea that powerful nations can’t seize territory from their neighbors, part of a broad appeal aimed at isolating Russia on the world stage. In an address to the U.N. General Assembly on Tuesday, Biden said if the U.N. abandoned its principles “to appease an aggressor, can any member state in this body feel confident that they’re protected?”

“If you allow Ukraine to be carved up, is the independence of any nation secure?” he asked. “I’d respectfully suggest the answer is no. We have to stand up to this naked aggression today and deter other would-be aggressors tomorrow.” Speaking hours later in his trademark olive shirt, the Ukrainian president accused Russia of using food and energy as a weapon in ways that hurt the countries represented in New York this week. “This is a real chance for every nation to ensure that aggression against your state—if it happens, God forbid—will end,” Zelensky said. “Ukraine is doing everything to ensure that after Russian aggression, no one in the world will dare to attack any nation.”

ANXIETY RIPPLES THROUGH THE DEMOCRATIC PARTY OVER BIDEN: A growing number of polls are showing voters concerned about President Joe Biden’s age and energy. Democratic lawmakers have hesitated to offer full-throated endorsements of his running mate. Prominent commentators have ruminated on whether he should drop out of the presidential race. This series of political vulnerabilities, along with House Republicans announcing an impeachment inquiry and the Justice Department indicting Biden’s son on gun charges, is now sending waves of anxiety through parts of the Democratic Party, as some fret about whether the man who helped oust Donald Trump from the White House may not have the vitality, at 80, to successfully prevent a return.

“He is in a period of his life where passing and death is imminent,” said Sharon Sweda, the leader of the Democratic Party in Lorain County in Ohio, who said she often hears from voters worried about the president’s potential frailty. “We are all on a ticking clock. But when you’re at his age or at Trump’s age, that clock is ticking a little faster, and that’s a concern for voters.” According to MSN, many in the party continue to voice confidence in Biden, and they note that Trump himself is not much younger at 77. But Biden’s allies are frustrated by the hand-wringing from an anxious faction of the party, and even as campaign officials point to the president’s record of defying skeptics, they are strategizing internally about how to best combat the unmistakable nervousness.

Other polls are also flashing warning signs for Democrats. A CNN/SSRS survey found that Biden’s approval rating was mired at 39 percent, with nearly three-quarters of respondents saying they were concerned about his age. The poll also found that most Democrats want the party to nominate a different presidential candidate.

➤NYC MAYOR LASHES OUT AT PRESIDENT: Eric Adams has lashed out at Joe Biden for snubbing him during his visit to the city - pointedly saying the president 'knows where I am.' Biden arrived in New York City on Sunday night for the annual gathering of world leaders at the United Nations General Assembly. He will remain in the city until Wednesday, but is not expected to meet the mayor - who has been strongly critical of his handling of the migrant crisis. Adams has frequently demanded Biden do more to stem the flow of arrivals - with more than 113,000 arriving in the city since spring 2022. He has been tearing into the migrant crisis crippling NYC - which he warned will 'destroy' the city without urgent action. Adams, the mayor of the largest city in the U.S., has admitted that he and Biden, both Democrats, have not spoken since the beginning of the year. 'President Biden's coming to the city,' said Adams on Tuesday, speaking at an event designed to improve New York's trash collection and reduce the rat population. 'I am hoping that he understands this beautiful city that's the economic engine of the entire country is been saddled with a $2 billion that we spent already, $5 billion we're going to spend in this fiscal crisis, $12 billion in the next two budgetary cycles.

➤2 CHARGED IN RUN-DOWN DEATH OF FORMER POLICE CHIEF: The teen car passenger who filmed himself encouraging his friend to mow down a retired police officer riding his bike through Las Vegas was arrested Tuesday, officials announced. The unidentified minor and the teen driver — who was already in custody — are both facing murder charges in the disturbing hit-and-run death of 64-year-old Andreas Probst last month, Las Vegas officials said at a press conference.

“It’s a complete lack of conscience on a part of it and the worst part about it in the video is you hear that everything was intentional,” Las Vegas Metropolitan Police Department Detective Lieutenant Jason Johansen said. Police say the passenger filmed the gut-wrenching video showing that Probst was deliberately struck and left for dead while he was on his morning bike ride around 6 a.m. on Aug. 14. The driver can be heard asking his giggling friend “ready?” as he speeds up directly behind the retired cop. “Yeah, hit his ass,” the passenger tells the driver before plowing into the retiree. Probst was thrown onto the windshield, sending shards of glass through the car, and over the car before crashing onto the side of the road.

TV, Cable Ratings Get Viewing Bump In August

Broadcast and cable viewing increased in August, posting gains of 1.6% and 1.7%, respectively. According to Nielsen, Broadcast, which experienced its first usage gain since January, benefited from increased “participation variety” (e.g., America’s Got Talent) and “general variety” (e.g., Big Brother) viewing to balance the steady news and drama genres, which accounted for 16.9% and 24.8% of viewing, respectively. Comparatively, the start of the NFL preseason and the arrival of the first presidential debate fueled viewing gains across cable, with sports and news accounting for 6.7% and 20.8% of viewing in August, respectively.

Streaming usage remained strong in August, but the return to school had an oversized effect on the 1.6% monthly dip in usage: Approximately 80% was due to decreased usage among viewers 2-17. Despite the drop in usage among kids, Disney+ had the third- and fourth-most watched titles: Bluey and Guardians of the Galaxy Vol. 3, with 4.2 billion and 3.2 billion minutes, respectively. The top two titles, Suits and The Lincoln Lawyer, remained strong, but not strong enough to offset a 4.8% drop in usage on Netflix. Peacock, which also carries Suits, was the biggest gainer, with usage rising 8.3% as a result of events like WWE SummerSlam, shared coverage of the NFL Hall of Fame Game and the success of The Super Mario Brothers Movie. While not included in the streaming category, linear streaming represented 5.1% of TV usage in August (please refer to the methodology for more information).

Despite its current stronghold with viewers, streaming platforms will see more competition in September as both the MLB playoff race narrows, and broadcast and cable benefit from broader coverage of new NCAA and NFL football seasons. With new scripted content in shorter supply this fall, it will be interesting to see how audiences navigate what remains a very vast and expanding TV landscape.
