PRESS Act Moves On For Full Floor Vote

The House Judiciary Committee has unanimously voted to pass Representatives Jamie Raskin (D-MD) and Kevin Kiley’s (R-CA) Protect Reporters from Exploitative State Spying (PRESS) Act. The PRESS Act would establish a federal statutory privilege to protect journalists from being compelled to reveal their sources and prevent federal law enforcement from abusing subpoena power. The legislation would be the first federal press shield law of its kind.

“In a giant step forward for press freedom in America, the House Judiciary Committee passed our PRESS Act with unanimous bipartisan support,” said Rep. Raskin. “The Constitution promises that no law shall abridge the freedom of the press and instructs us to protect journalists from government overreach and abuse of power, and today this committee has made good on that promise. I’m thankful to my colleagues on the Judiciary Committee for unanimously supporting the PRESS Act, and I look forward to seizing this momentum to pass it into law.”

The PRESS Act is supported by a broad coalition of press and media freedom organizations and advocates nf now moves on the full House for consideration.

You Pay More At YouTube

YouTube, Google's video streaming platform, hiked prices on its monthly and annual premium plans in the United States for the first time since the subscription service was launched in 2018.

Reuters reports the YouTube Premium plan would cost $13.99 a month in the U.S., up $2 from before, according to the company's website on Thursday. The price for its annual plan was hiked by $20 to $139.99.

Members who subscribed five years ago, including those who signed up originally through Google Play, would get three more months of subscription at the old price, according to YouTube.

YouTube had in April introduced new features for its premium users including letting them host Google Meet sessions to watch videos on the platform together with other users.

It has also hiked prices for YouTube Music by $1 to $10.99 in the U.S. The move follows similar price increases by Amazon Music, Apple Music and Tidal.

Four More Years For Dan Patrick

On the “Dan Patrick Show” on Wednesday, the crew was discussing throwing in money for a pool of Powerball tickets. At this time, Patrick said that they would continue working — for as long as he wanted to continue doing the show.

That’s when producer Marvin Prince raised his hand and asked Patrick how much longer he would work.

“Four more years,” Patrick said.

He’s hosted his eponymous show since 1999, when it was on ESPN Radio, taking control of the program himself when he left the network in 2007.

Nielsen: Kids Push TV Usage Up In June

As kids closed their books to end another school year, TV usage trends in June began to turn the corner after a four-month seasonal lull that began in February. For kids 2-17, streaming and video gaming provided a nice break from the classroom—and a 2.2% increase in total TV usage across all age groups, according to Nielsen.

Among kids 2-17, non-traditional TV options accounted for 90% of their increased usage. Kids 2-11 increased their TV time by 16.3%, while kids 12-17 spent 24.1% more time with TV compared with May.Among kids 2-11, streaming accounted for 62% of the increase, and “other” usage accounted for 30%, primarily attributed to video game console usage. Among kids 12-17, the increased time was fairly evenly split at 43% and 46% for streaming and other, respectively.

Compared with relatively flat cable usage and a 6.6% drop in broadcast usage, streaming usage jumped 5.8% to secure 37.7% of total TV, a new high-water mark. S.W.A.T. played a big role in that increase, attracting almost 5 billion minutes after becoming available on Netflix in mid-May alongside Hulu and Paramount+. Star Trek: Strange New Worlds was another audience pleaser, generating almost 1 billion minutes of viewing after season 2 dropped in mid-June. The boost helped Paramount+ capture 1% of TV viewing and obtain stand-alone coverage in The GaugeTM. Other streaming highlights included:Tubi TV was the leading FAST service, as usage increased 12.1% to account for 1.4% of TV usage (up from 1% in February 2023 and tied with Max).

NewsGuild Files Grievance Against The NY Times

The union representing the New York Times newsroom filed a grievance Thursday challenging the company’s announcement that it plans to shutter its standalone sports desk and rely on the Athletic for its sports coverage in print and online.

The Washington Post reports the grievance, sent from the NewsGuild to Times executives, accused the company of violating the union contract by “unilaterally removing bargaining unit work and by assigning such work to non-bargaining unit employees, namely the employees of The Athletic, a company owned by the New York Times.”

In a statement Thursday, the guild said: “The Times Guild has jurisdiction over journalism jobs at The Times, yet the company is claiming it has the right to subcontract to itself and have nonunion workers do union work without the same job protections, wages and other benefits we have fought so hard to secure. These claims are preposterous on their face and a brazen attempt at union-busting.”

The Times declined to comment on the grievance, but Times spokeswoman Danielle Rhoades Ha pointed to a note written to the newsroom last week by Times chairman A.G. Sulzberger and CEO Meredith Kopit Levien, which highlighted that the Times has added nearly 1,000 journalism jobs in recent years, half of which have been in the Times newsroom.

The guild is not challenging the dissolution of the sports desk but rather that the Times can rely on non-guild labor to produce its sports coverage, arguing that the Times is violating its collective bargaining agreement by subcontracting to itself.

The Athletic is a subscription sports publication the Times bought last year for $550 million. Its newsroom of around 400 writers and editors is not unionized.

The Times has 20 days to respond to the grievance. If the Times denies it, which is expected, the guild has 45 days to file for an arbitration hearing. The arbitrator could rule that Times sports coverage is guild work, which would mean its sports coverage couldn’t be subcontracted to the Athletic and the Times newsroom would have to produce the Times’s sports coverage. If the arbitrator were to side with the Times, it could set a precedent that the Times can outsource the work of a section to non-guild workers.

Capitol Rioter Sues CNN for $37 Million

A Virginia man who admitted to entering the U.S. Capitol during the January 6 riot is suing CNN for defamation.

Newsweek reports Jacob Hiles, a charter boat captain, traveled from Virginia Beach to Washington, D.C., on January 6, 2021, to "express his support for President [Donald] Trump by exercising his 1st Amendment rights guaranteed to him under the United States Constitution," according to a lawsuit filed in the U.S. District Court for the Eastern District of Virginia earlier this week and reviewed by Newsweek.

Hiles pleaded guilty to one misdemeanor count of parading, demonstrating or picketing in a Capitol building in September 2021. He was sentenced in December 2021 to two years of probation and ordered to complete 60 hours of community service.

Jacob Hiles
His lawsuit alleges CNN defamed him in an article published on October 15, 2021, with the headline: "US Capitol Police officer indicted on obstruction of justice charges in connection with January 6."

The article reported on the indictment of Michael Angelo Riley, a Capitol police officer who prosecutors said messaged Hiles on Facebook and encouraged him to delete his posts. Riley was sentenced to two years of probation and four months of home detention earlier this year after being convicted on one count of obstruction of justice.

The article's focus later shifts to Hiles, with a subheading that says: "Man wanted to start 'a revolution' on January 6."

According to the lawsuit, that subheading and the article's contents are defamatory because "they falsely accuse Hiles of felonious criminal activity of which he was not charged or convicted, either directly or indirectly."

The lawsuit says CNN acknowledged that Hiles pleaded guilty to one misdemeanor "but continued to mislead their viewers by painting a picture of a violent revolutionary intent on causing violence on January 6, 2021."

TV Ratings: All-Star Coverage Dominated The Week

Viewership for Major League Baseball's All-Star Game set a record low for the fourth time in its last five editions, but was still the most-watched all-star game in sports for the eighth consecutive year it has been played.

Fox's coverage of the National League's 3-2 victory over the American League at T-Mobile Park in Seattle on July 11 averaged 7.006 million viewers, the most among prime-time broadcast and cable programs airing between July 10 and Sunday, according to a posting at KFI radio citing live-plus-same-day figures released by Nielsen.

The previous low was 7.507 million last year for the American League's 3-2 victory at Dodger Stadium. There was no All-Star Game in 2020 because of the delayed start to the season caused by the coronavirus pandemic. Viewership figures are available dating back to 1972, except for the 1974 and 1981 games. Fox has carried each All-Star Game since 2001.

The total viewership was 7.091 million viewers, which includes the Spanish-language network Fox Deportes. The total viewership among viewers ages 18-49, the group most coveted by advertisers, was 2.17 million, a 6% increase over the 2.04 million for the 2022 game, the first increase among the group since 2017.

The record audience for the All-Star Game came in 1976, when an average of 36.33 million viewers watched ABC's coverage in an era when there were three major broadcast networks and few other television alternatives.

The Home Run Derby was the week's only other prime-time program to average more than 6 million viewers, averaging a combined 6.11 million viewers on ESPN and ESPN2, the most for any program on ESPN this summer.

Official viewership for most forms of programming is down compared to the past primarily due to higher viewership of streaming programming, including the same programs shown on traditional television, as well as increased options for leisure time.

"America's Got Talent" extended its streak of being the most-watched non-sports prime-time program for each of its six episodes, despite averaging a season-low 5.615 million viewers opposite the All-Star Game. Its previous season low was 5.963 million viewers June 13.

CBS had five of the week's 10 most-watched programs -- "60 Minutes," three reruns of "The Price is Right at Night" and a "Young Sheldon" rerun -- to finish first in the network race for the fourth consecutive week, averaging 2.57 million viewers.

Fox finished second, averaging 2.36 million viewers for its 17 hours, 33 minutes of prime-time programming. Its most-watched program outside of the All-Star Game was the professional wrestling program "WWE's Friday Night Smackdown," 34th for the week, averaging 2.302 million viewers.

NBC finished third among the major broadcast networks for the second consecutive week following back-to-back second-place finishes, averaging 2.29 million viewers.

ABC averaged 2.17 million viewers to finish fourth, one week after finishing second. A rerun of "America's Funniest Home Videos" was its most- watched program, averaging 3.211 million viewers, finishing 11th.

CBS, NBC and ABC all aired 22 hours of prime-time programming.

The 20 most-watched prime-time programs consisted of Fox's coverage of the Major League Baseball All-Star Game; the ESPN and ESPN2 simulcasts of the Home Run Derby and 19-minute preview show; the NBC alternative series "America's Got Talent" and "American Ninja Warrior" and the finale of its scripted series "The Blacklist"; CBS' "60 Minutes"; Univision's coverage of Sunday's CONCACAF Gold Cup final between Mexico and Panama and Wednesday's semifinal between Mexico and Jamaica; three reruns of "The Price is Right at Night" on CBS; reruns of four CBS scripted series; and four episodes of ABC alternative series.

Fox News Channel was the most-watched cable network for the third consecutive week and fourth time in five weeks, averaging 1.449 million viewers. It was first among cable news networks for the fifth consecutive week and 125th time in 126 weeks.

ESPN was second, averaging 1.22 million viewers and MSNBC third, averaging 1.139 million.

CNN was third among cable news networks and 13th overall, averaging 541,000 viewers.

The Five is the No. 1 show on cable news for the 12th consecutive week, averaging 2.51 million total viewers at 5 p.m. for the week of July 10. Fox News had nine of the 10 most-watched cable news shows of the week, including the top seven. MSNBC placed The Last Word with Lawrence O’Donnell at No. 8.

📺STREAMING TV

Netflix's most-watched title was "King The Land," with viewers spending 51.8 million hours watching the Korean drama.

"The Out-Laws" was Netflix's most-watched film for the second consecutive week, with viewers spending 46.3 million hours watching the romantic action comedy the first full week it was available, 46.1% more than the 31.7 million hours watched the previous week when it was available for three days.

📺BROADCAST EVENING NEWS

ABC's "World News Tonight with David Muir" was the most-watched nightly newscast for the 241st time in 242 weeks, averaging 7.372 million viewers. "NBC Nightly News with Lester Holt" was second, averaging 5.782 million viewers. The "CBS Evening News with Norah O'Donnell" was third, averaging 4.284 million viewers.

7/20 WAKE-UP CALL: Congressional Hearing Gets Explicit

The mystery surrounding Whistleblower X ended Wednesday as Joseph Ziegler, who has worked with the IRS since 2010, appeared to claim that Hunter Biden received preferential treatment in the investigation into his financial dealings. At the same time, a pre-recorded interview with Ziegler was released where he said that anytime the IRS tried to look into President Joe Biden they were told 'we can't ask those questions.'  Ahead of his appearance, the name plate Mr. Ziegler was placed at the witness table next to unveiled whistleblower and IRS Supervisory Special Agent Gary Shapley's spot.

➤HEARING GETS EXPLICIT: Marjorie Taylor Greene shared explicit images of Hunter Biden with prostitutes during the Oversight Committee hearing on Wednesday. The Georgia congresswoman warned parents watching at home before her time questioning IRS whistleblowers that 'discretion is advised.' The shocking moment went out on the C-SPAN live stream as well as other cable network channels airing the hearing, including Fox News.  'Should we be displaying this?' Democratic Ranking Member Jaime Raskin questioned at one point during crosstalk with other members of the panel. The images from Hunter's laptop hard drive were printed on poster board that Rep. Greene held up at the hearing that showcased President Joe Biden's son engaged in sex acts with prostitutes. The reason for showing the images, other than to shock viewers, was for Greene to ask about Hunter Biden writing off taxes for costs related to escorts, prostitutes and sex clubs.

➤SUPPORTS GROWS TO BAN LAWMAKERS FROM OWNING STOCK: Two senators are set to introduce legislation to bar executive-branch members and lawmakers from owning stock in individual companies, even in blind trusts. The bill from Sens. Kirsten Gillibrand (D., N.Y.) and Josh Hawley (R., Mo.) would still allow the president, vice president, members of Congress, Capitol Hill aides and employees of the executive branch to own mutual funds and broad industry and index funds. Polling shows broad public support for such a ban. The legislation comes after a WSJ investigation, which found that many top executive-branch employees owned stocks in companies their agencies regulate. Elsewhere in Washington, antitrust authorities issued new proposed-merger guidelines, which could help the government’s efforts to block deals.

🏠BRAND-NEW HOMES SALES BOOMING: High mortgage rates are dissuading sellers who can’t afford to give up the low rates they have now. So, newly built homes accounted for nearly one-third of single-family homes for sale nationwide in May, compared with a historical norm of 10% to 20%, according to the National Association of Realtors. Existing-home sales in May fell 20% year-over-year, while new single-family home sales that month rose 20% on an annual basis. So far, the home-building revival, coupled with financial incentives some builders offer, is providing only minor relief to prospective buyers. Developers aren’t erecting enough homes to offset the shortage, which still means bidding wars in many places, and home prices remain high nationally.

Netflix Quarterly Revenue Misses Forecasts

Streaming video pioneer Netflix disappointed Wall Street on Wednesday with second-quarter revenue that fell short of analyst estimates, sending shares tumbling nearly 9% in after-hours trading.

Reuters reports the revenue figure, along with a weaker-than-expected forecast for revenue in the third quarter, overshadowed the addition of 5.9 million new streaming customers from April through June and earnings that easily topped predictions.

The Wall Street Journal reports the company gained 5.9 million subscribers, after losing nearly one million customers in the year-ago quarter, as people who are no longer able to share the service for free opted to pay for their own accounts. The company said it is now rolling out that effort in nearly every remaining country.

The continuing Hollywood writers and actors strikes have led Netflix to spend less on content this year, the company said. It raised its free cash flow forecast to $5 billion from an earlier estimate of $3.5 billion.

“This strike is not the outcome that we wanted,” co-Chief Executive Ted Sarandos said. The company had hoped to have reached new contracts with the unions by now and is committed to forging an agreement “as soon as possible,” he said.
