On Monday, a Los Angeles judge ruled that there was "no urgency" requiring the 92-year-old Viacom chairman to take questions in the case. However, Viacom CEO Philippe Dauman, who serves as Redstone’s current health care agent, will have to meet with Herzer's lawyers for a series of depositions about the mogul's health.
Herzer filed her lawsuit in November after Redstone revoked her control over his healthcare decisions.
Herzer claims Redstone "lacked the mental capacity" to make such a decision. Redstone's lawyers are now seeking to have the case dismissed. In a statement, they said they were "glad Mr. Redstone will be able to continue to enjoy the holiday season with his family and friends uninterrupted..."
