Canton OH Radio: 'Mo' Sues WDJQ For Contract Breach

Ohio Radio host Bryan Modzelewski, known to his many fans as “Mo,” filed a lawsuit Wednesday afternoon in the Stark County Court of Common Pleas against his former employer, WDJQ Q92 FM in Alliance, OH, according to a press release.

Mo was the morning host of “The Mo Radio Show” heard on Q92 since 2012.

The lawsuit alleges that Q92 breached Mo’s employment contract when it fired him on February 15, 2016 without cause and without notice or pay.    (Click Here for posting)

“Mo’s contract with Q92 is clear on this point,” said his attorney, Steven Okey of The Okey Law Firm in Canton.

“If Q92 wanted to fire Mo without cause, the written contract requires the station to give him notice or pay.  They failed to do either.  Q92 clearly broke its promises under the contract.”

 The lawsuit asks the court to require Q92 to pay the earnings that Mo lost because of Q92’s breach of contract.  The lawsuit also asks the Court to throw out the contract’s non-compete clause.

“Even though Q92 breached the contract, they now say that Mo can’t earn a living doing the work he loves.  But Q92 can’t have it both ways.  It can’t breach the contract and then turn around and try to enforce the other parts of the same contract,” said Okey.  

This is the second case that Okey has had against Q92.  In 2012, Okey successfully represented morning co-hosts Patrick DeLuca and Charlotte DiFranco in a groundbreaking case against Q92.
