Cleveland Radio: Rover Trial Date Is May 20

Cuyahoga County prosecutors say that the case against WMMS 100.7 FM personality Shane French should not be dismissed because of an accidentally deleted interview with a key witness – the off duty Cleveland police officer who said the host, known as "Rover," assaulted him this summer.

According to cleveland.com, Attorneys for French argued last month that police had destroyed the first audiotaped statement made by Cleveland police officer Steven Kinas and replaced it with a second statement that was riddled with inconsistencies when compared with written police incident and use of force reports.

They asked Cuyahoga County Common Pleas Judge Brian Corrigan to dismiss charges against French and Michael Toomey, another radio personality who was also arrested and charged. Corrigan has not ruled on the motion.

Officer Steven Kinas reported that he was on his boat at a Whiskey Island marina last July when a drunken French shot fireworks in his direction – nearly hitting him at one point. The officer said he confronted French, who then shoved the officer. Other Cleveland officers later arrested French that morning.

French, 38, of Avon and Toomey, 29, were indicted in October on charges including assault, criminal damaging, resisting arrest, including panic.

Both have pleaded not guilty to the charges, which on air French called "absolutely absurd, ridiculous and not based in fact whatsoever."
