For the third time this year Arbitron has filed a copyright
infringement suit against a broadcaster for allegedly gaining access to its
ratings data without being a subscriber.
According to an Inside Radio story, Arbitron says Renda
Broadcasting’s Jacksonville
cluster received the information from a “longtime friend and business
associate” at a local advertising agency.
According to the suit, filed last week in U.S. District
Court in Jacksonville ,
Renda general manager Bill Reese at first received the ratings information in
the form of printouts, but later the cluster was sent emails with the
information. It claims Reese promised to
shred the ratings once they’d had a look.
Arbitron says the ad agency also sent ratings to WGNE 99.9 Gator Country sales manager Charlie Jennings, operations manager Chuck Beck, and AC WEJZ Lite 96.1 morning personality Arthur Crofton.
Arbitron is seeking at least $650,000 in damages.
But the 13-page lawsuit doesn’t seek damages from the ad
agency that shared the data.
